How to make an employment tribunal claim: 4 steps, with your last day worked out

Dismissed before 1 October 2026: 3 months less a day. Dismissed from 1 October 2026: 6 months less a day. If you were dismissed on 15 September 2026, your last day is 14 December 2026; if on 1 October 2026, it is 31 March 2027.

The 4 steps

  1. Work out your last day. Use the calculator above: the date it happened decides between 3 and 6 months.
  2. Tell Acas before that day. Early conciliation can last up to 12 weeks, and your clock pauses while it runs.
  3. Get the certificate. With no deal, Acas gives you a certificate with a number, and you have at least 1 month after it.
  4. Make the claim on the ET1. Online on GOV.UK or by post, with 1 certificate number for each employer you claim against.

After step 4, the tribunal decides. Past your date? A tribunal can still accept a late claim in some cases; that is its decision, and it is hard to win.
